What is a minor dwelling?

The  Auckland Unitary Plan (Operative in part) (AUP(OP)) defines minor dwellings in Chapter J as follows:

  • Minor Dwelling

  • A dwelling that is secondary to the principal dwelling on the site.

This means that minor dwellings are not the same as principal dwellings. Different rights and restrictions apply to minor dwellings and they can be expected to have a lower standard of amenity than principal dwellings. This is because they may depend on some of the functions of the principal dwelling, such as shared driveways, shared pedestrian access, shared amenity space, etc.
What is the AUP trying to achieve with minor dwellings?
In the Single House Zone and the rural zones, the question as to whether a second dwelling on a site is a minor dwelling is important in terms of the integrity of the AUP. This is because in these zones the AUP(OP) is intentionally enabling the opportunity for additional ‘secondary’ housing of a smaller scale in zones which are otherwise
not anticipating more than one dwelling per site. This is provided for through the minor dwelling provisions.
If this question is not carefully considered, there is the potential that a significant number of sites in these zones will see second dwellings (which are not minor dwellings) as opposed to secondary dwellings, established incrementally.

How is a minor dwelling distinguished from a principal dwelling?

Whether a dwelling is a 'minor dwelling' or a 'principal' dwelling will often depend on several factors, such as the relative size and location of the minor dwelling compared to the principal dwelling. Generally speaking, if the second dwelling is 65m2 or less then it will usually be able to be considered as a minor dwelling activity. However, there can be exceptions as a dwelling with a small footprint will not always be a
minor dwelling. For example, where an applicant proposes two new dwellings that are each 65m2 or less and they are clearly designed to function as fully independent dwellings and not as a principal dwelling and a minor dwelling.

 

Work from home / home and income: are these classed as Minor dwellings?

Designing and building a separate space on a residential site can be a valuable investment, especially if that space can be rented. However, deciding at the outset the intentions for the space is crucial, as the type of space it is will determine what regulations the build falls under and what consent is required. 
If the space is intended as a secondary or minor dwelling, there is a clear set of compliance requirements. If the space is intended only as a workspace or office, there are fewer compliance requirements and the project becomes more about designing a space that provides the right features for the intended use, Philip says.

Regulations for minor dwellings Auckland – check your consent requirements

If you are planning to add a second building on your Auckland section it is important to check the regulations for minor dwellings to ensure that you aren’t going to be breaking any rules.
The introduction of the Auckland Unitary Plan, however, has made it much easier to add a second dwelling to your section without the need for subdivision or extra consents. This means that sections that currently only contain one property could now be built on without such a costly process.
Minor dwellings can be used for all kinds of purposes from granny flats for elderly relatives to home offices. You might even consider adding a minor dwelling as a rental for extra income – a perfect opportunity given Auckland’s current squeeze on housing and the number of people looking for quality properties.
There are different minor dwellings rules depending on where in Auckland your current property is. This means you need to check the Auckland council minor dwelling rules for your particular property carefully.

The unitary plan dictates zones for each area of land which shows how it is used and what happens there. Zones can include residential, commercial and conservation. Many existing Auckland houses will fall under one of three categories. These are Single House Zone, Mixed Housing Suburban Zone and Mixed House Urban Zone.
Single House Zone – a minor dwelling can be built of up to 65m2.
Mixed Housing Suburban Zone – each section can have up to two dwellings without resource consent
Mixed House Urban Zone – each section can have up to two dwellings without resource consent and buildings can be higher.
Different zones will have different regulations and different restrictions on building. For instance what you can build, how high a building can be and what you can use the building for.
You will need to check that your minor dwelling plans meet the criteria for your zone, especially if you are planning to use the building for commercial purposes or want to subdivide before you build.
Regardless of the zone, your property is in, you may also need a building consent for your project. This may be necessary depending on things like:

  • the floor size
  • the height of the building
  • how close it is to the section boundaries or other homes
  • whether it will have cooking and toilet facilities
 

Minor dwellings can only be built in the; single house, large lot residential, and rural & coastal Auckland Unitary Plan zones

THEY MAKE GREAT INVESTMENTS!

  • A Minor Dwelling is an additional minor household unit (mhu) built on an existing title of land to a maximum 65m2 size, and are generally not sub-dividable.
  • They include; living, kitchen, sleeping, and bathroom areas for independent living and can be built adjoining to, within, or separate from the existing home. We often build them on top of garages and/ or as part of home extensions.
  • Utility services (power, water, telecom etc) can either be sourced from the existing home (using check meters for accountability) or constructed 100% independently.

Recent changes to planning rules under the Auckland Unitary Plan provide huge potential in terms of the development of minor or secondary dwellings on larger sites.
The Unitary Plan highlights areas of Auckland where higher density developments can be built - areas where minor dwellings may not have been approved previously.
“The changes open the doors to new possibilities for minor dwellings, work from home or home and income developments on existing residential sites,” The House Company’s Philip Powney says. “It’s a great opportunity to add additional accommodation on sites within existing communities where the infrastructure is already in place.”

There are a considerable number of requirements and associated costs that need to be sorted out up front before building work can begin. Don’t be fooled by some of the so-called cheap prices being banded around in the media about minor dwellings being as cheap as $69,000. That price was excluding GST and was for materials only. It didn’t include builder’s labour, plumbing, electrical or any of the following costs that may be required:

  • Concept and Working Drawings by an Architectural Designer
  • Site topographical/contour survey and marking boundaries by a registered surveyor
  • Geotech Engineering often required for foundation works
  • A Structural Engineer that may be required for specific structural design of foundations or bracing etc
  • Sometimes a Town Planner may be required and can be engaged to work through the Resource Consent process if necessary
  • Building Consent fees 
  • There are a number of reasons why a Resource Consent my be required – Building over pipes, Height to boundary infringement or woring through a council Overlay e.g. a Heritage Area etc
  • Some sites require a Flood Report and specific foundation design if they are in a flood plane or have an Overland Flow Path on the site
  • Council Contributions are also required for site developments
  • Most sites these days also require retention tanks for stormwater mitigation to stop flooding in the streets

Other costs to consider could be the following:

  • Services connections like power, water, sewer and fibre. If the property is subdividable it may pay to put in new connections rather than connecting to the existing main house services
  • Landscaping and retaining walls
  • Driveways, decks and fences

We will work through all these requirements up front and determine what is necessary for your site. We will try and include as much as possible in our Preliminary Building Agreement so that you are as informed as possible around the costs associated with your build.
Generally you will need a budget starting from a minium of $200K and it will depend on what is actually required for your site, the spec and level of finish you want and the actual size and design.
There are two main types of minor dwellings: standalone dwellings and integrated minor dwellings that become part of the structure of the main house and extend its footprint.
Those that are attached to the main house must comply with all relevant standards including fire and noise ratings. 
For standalone dwellings, these become redundant as the minor dwelling is completely separate from the house,” Philip says.
Either way, there are basic requirements for adding a minor dwelling to an existing residential site, including that the minor dwelling and main house must be accessed from the same driveway, that there is sufficient parking space, and that the minor dwelling must have an independent outdoor living area.
